This communication reports that Mayor James F.
January 18, 2022 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning without my signature Bill No. 210899, which was passed by Council at its session on December 16, 2021. Bill No. 210899 amends the Philadelphia Zoning Code by amending Chapter 14-1000, Historic Preservation, to establish a temporary demolition moratorium with respect to properties in the area bounded by Henry and Roxborough Avenues and Silverwood and Fountain Streets. This Bill will create a one-year demolition moratorium within an area of Roxborough known for Victorian homes. This will include the removal or partial removal of structural elements for the purpose of removal of an entire structure. This is intended to allow for the application of the Victorian Roxborough Historic District to be processed before any other demolitions are carried out in this specific neighborhood. The Philadelphia City Planning Commission (PCPC) reviewed this legislation and recommended agai...

January 18, 2022 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning without my signature Bill No. 210689, which was passed by Council at its session on December 16, 2021. Bill No. 210689 amends the Zoning Maps by changing the zoning designations of certain areas of land located within an area bounded by Old York Road, Broad Street, and 65th Avenue. The purpose of this bill is to facilitate redevelopment of a vacant lot with a seven-story mixed-use building including 65 dwelling units, retail sales, restaurant, and office uses, and 49 accessory parking spaces. The Philadelphia City Planning Commission (PCPC) reviewed this legislation and recommended against approval. The PCPC noted that the proposed amendment is not consistent with the zoning or land use recommendations from the Upper North District Plan, part of the Philadelphia2035 Comprehensive Plan. Whereas the District Plan recommends "context-sensitive" buildings and neighborhood-s...

January 18, 2022 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning without my signature Bill Number 210669, which was passed by Council at its session on December 16, 2021. Bill Number 210669 would provide for submission to the qualified electors of the City of Philadelphia an amendment to The Philadelphia Home Rule Charter (Charter). Per Resolution Number 210692, this Charter amendment would revise the composition of the Zoning Board of Adjustment (ZBA) in the following ways: (1) increase the size of the board from five to seven members, all of whom would continue to be appointed by the Mayor; (2) provide for Philadelphia City Council confirmation of these appointments; and (3) require that the ZBA include members who possess specified areas of expertise and members who are recognized leaders from community organizations. While the Administration supports the intent of this Charter change to address issues with the ZBA, the change woul...

January 18, 2022 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning without my signature Bill No. 210865, which was passed by Council at its session on December 9, 2021. Bill No. 210865 amends the "/FNE, Far Northeast Overlay District," to prohibit eligibility for floor area, height, and dwelling unit bonuses and to increase minimum parking requirements. The Philadelphia City Planning Commission (PCPC) reviewed this legislation and recommended against approval. The PCPC noted that this bill may reduce the ability to construct new by-right housing in part of the City where demand is growing and the one parking space per one unit ratio does not support a walkable commercial corridor. It further noted that the prohibition of bonuses will hinder Citywide initiatives to manage stormwater and support housing programs. While my Administration shares the concerns of the PCPC, I understand that the bill sponsor intends to introduce additional l...

This communication, placed on file, reports that the mayor returned without signing Bill 210744, which would have changed zoning designations for land bounded by Germania Street, Arendell Avenue, Delaware Avenue, and Linden Avenue.
January 18, 2022 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning without my signature Bill Number 210744, which was passed by Council at its session on December 9, 2021. Bill Number 210744 would amend the Philadelphia Zoning Maps by changing the zoning designations of certain areas of land located within an area bounded by Germania Street, Arendell Avenue, Delaware Avenue, and Linden Avenue. The Philadelphia City Planning Commission (PCPC) reviewed this legislation and recommended against approval. The PCPC noted that the block's primary use is for single-family detached homes, with just under half of the Delaware Avenue frontage devoted to a restaurant and bar, and its associated parking lot. The restaurant and bar is currently operating pursuant to a zoning variance that includes a proviso limiting the expansion of its operations. The PCPC noted concerns that the remapping is not reflected in the North Delaware District Plan and...
