Granting permission to the owners of certain newsstands located within the First Councilmanic District to construct, use and maintain, on a temporary basis, newsstands with a greater dimension of advertising than that permitted by general ordinance; in particular, granting such permission with respect to the owners of the newsstands located at the southeast corner of Broad and McKean streets, the southeast corner of Broad and Tasker streets, the southwest corner of Tenth and Reed streets, the southeast corner of Thirteenth and Mifflin streets, the northeast corner of Juniper and Market streets, the northwest corner of Tenth and Market streets, the northeast corner of Ninth and Market streets, the southeast corner of Eighth and Market streets, and the northeast corner of Eleventh and Walnut streets; all under certain terms and conditions.

Full Bill

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1.

(a)

Permission is hereby granted to each newsstand owner listed in subsection 1(b) to construct, use and maintain, with respect to the listed location, and on a temporary basis, a newsstand that in all respects conforms with all laws and ordinances relating to newsstands, including Section 9-212 of The Philadelphia Code, except that the illuminated advertising on the street side of the newsstands may be a maximum of six feet (6’) wide by four feet (4’) high, notwithstanding any contrary provisions of subsection 9-212(5)(f)(.2)(i) of The Philadelphia Code.

(b)

The permission granted under subsection 1(a) applies to the following owners and locations:

(c)

No City department, agency, board or commission shall be required solely by virtue of this Ordinance to issue any permit, license, or approval that a newsstand owner listed in subsection 1(b) must by law obtain prior to construction or maintenance of a newsstand at the location listed in subsection 1(b), it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals except as expressly set forth in subsection 1(a).

SECTION 2. The permissions granted by this Ordinance shall be for a period of one year from the date this Ordinance becomes law, and shall not obligate the City to grant permission to any person to maintain any newsstand at any location listed in subsection 1(b) at any time after the expiration of said one year period, whether under the terms and conditions of Section 9-212 of The Philadelphia Code or under the special terms set forth in this Ordinance.
