WHEREAS, The Local Option Small Games of Chance Act, Act 156 of 1988, as amended (the Act), provides for the licensing of certain charitable, religious, fraternal and veterans organizations to conduct small games of chance; and,
WHEREAS, The Act applies only to such organizations located within municipalities that have approved the issuance of licenses through a specific referendum question; and,
WHEREAS, Under Section 14 of the Act (10 P.S. § 324), such a referendum question is to be submitted to the voters at the primary election immediately preceding the municipal election if the governing body of the municipality adopts, by a majority vote, a resolution to place such a question on the ballot and a copy of the resolution is filed with the Board of Elections of the county; and,
WHEREAS, The Council wishes to afford the voters of the City an opportunity to authorize the licensing of small games of chance, as permitted under the Act, in Philadelphia; now therefore
RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA:
That the City Commissioners are directed, pursuant to Section 14 of Act 156 of 1988, to submit to the voters the following question at the primary election to be conducted in 2001:
Do you favor the issuance of licenses to conduct small games of chance in the City of Philadelphia?
FURTHER RESOLVED, That a true and correct copy of this resolution shall be submitted to and filed with the City Commissioners forthwith.
