Authorizing the Commissioner of Public Property to select and appropriate a certain right-of-way through 8480 Hagy's Mill road for construction, reconstruction, alteration, connection, operation, maintenance, and inspection of water facilities, partly along and within the bed of Paleski road, a private street, from Hagy's Mill road to approximately 489 feet southwesterly of Hagy's Mill road.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1.

The Commissioner of Public Property is hereby authorized to select and appropriate the following described tract of land forming a right-of-way through 8480 Hagy's Mill road for construction, reconstruction, alteration, connection, operation, maintenance, and inspection of water facilities, partly along and within the bed of Paleski road, a private street, from Hagy's Mill road to approximately 489 feet southwesterly of Hagy's Mill road.

ALL THAT CERTAIN right-of-way for water purposes situated in the 21st Ward of the City of Philadelphia and described according to a plan of property made on June 22, 2000 by Francis Bevenour, Chief Surveyor of the Water Department.

BEGINNING AT A POINT, said point being measured the following two (2) courses and distances from the intersection of the Philadelphia-Montgomery County Line and the centerline of Hagy's Mill road (33 feet wide); south seventy-two degrees thirty-seven minutes one second east, a distance of 561.458 feet to a point in the centerline of Hagy's Mill road; thence south thirty-nine degrees twenty-eight minutes one second east, a distance of 66.364 feet to the point of beginning; thence from the point of beginning south forty-nine degrees twenty-two minutes fifty-nine seconds west, a distance of 44.2014 feet to a point; thence south thirty-nine degrees thirty-seven minutes forty-three seconds east, a distance of 387.1556 feet to a point; thence south eighty-four degrees thirty-seven minutes forty-three seconds east, a distance of 35.3553 feet to a point; thence south thirty-nine degrees thirty-seven minutes forty-three seconds east, a distance of 86.4317 feet to a point; thence north forty-nine degrees thirty-two minutes fifty-eight seconds east, a distance of 24.7525 feet to a point; thence north thirty-nine degrees thirty-seven minutes forty-three seconds west, a distance of 96.682 feet to a point; thence north eighty-four degrees thirty-seven minutes forty-three seconds west, a distance of 35.0018 feet to a point; thence north thirty-nine degrees thirty-seven minutes forty-three seconds west, a distance of 351.2628 feet to a point; thence north fifty degrees thirty-one minutes fifty-nine seconds east, a distance of 59.9708 feet to a point; thence north seventy-two degrees thirty-seven minutes one second west, a distance of 19.7076 feet to a point; thence south fifty degrees thirty-one minutes fifty-nine seconds west, a distance of 30.0735 feet to a point; thence north thirty-nine degrees twenty-eight minutes one second west, a distance of 9.854 feet to the point of beginning.

SECTION 2.

The City shall obtain a right-of-way for water purposes over and through the above-described land.

SECTION 3.

The Commissioner of Public Property shall execute is authorized to enter into a right-of-way agreement upon certain terms and conditions in a form satisfactory to the City Solicitor for the purchase of a right-of-way. The Water Commissioner is authorized to develop the right-of-way for water main purposes.

SECTION 4.

The amount of the appropriation when ascertained and assessed shall be charged against the Capital Budget to the Water Department which has been made or may hereafter be made for "Conveyance System".

SECTION 5.

This Ordinance shall take effect immediately.
