Amending an Ordinance (Bill No. 494, approved June 2, 1993) adopted pursuant to the provisions of the "Municipalities Authorities Act of 1945," P.L. 382, as amended (the "Act") in order to add to the district to be served by the South Street/Headhouse District of Philadelphia ("The Authority") certain properties ("the proposed expansion") in the vicinity of but previously excluded from the district to be served by the Authority, and amending an Ordinance (Bill No. 970275, approved December 29, 1997) adopted pursuant to the provisions of the Act, in order to substitute and approve a plan and budget for a district that includes both the area previously served by the Authority and the area of the proposed expansion.

Full Bill

WHEREAS, Under the Act, the City of Philadelphia (the "City") authorized in an Ordinance approved on October 9, 1992 (Bill No. 209) the organization of an authority to be known as the South Street/Headhouse District of Philadelphia ("The Authority") for the purpose of making business improvements and providing administrative services, as those terms are defined in the Act, for the South Street/Headhouse area of the City of Philadelphia; and

WHEREAS, Articles of Incorporation were filed with the Secretary of the Commonwealth of Pennsylvania and the Authority was incorporated on January 15, 1993; and

WHEREAS, The City of Philadelphia, by Ordinance (Bill No. 494) approved on June 2, 1993, specified the district to be served by the Authority (which was referred to in that Ordinance as "the SSHD") by (i) providing in Section 1 of such Ordinance that:

SECTION 1.

The Plan, including the maps and other documents which form a part of the Plan submitted by the SSHD, having been duly reviewed and considered, is approved.

and the map generally describing such district, which formed a part of such Plan, is attached hereto as Exhibit "A"; and by (ii) providing in Section 2 of such Ordinance that:

SECTION 2.

The area to be served by the SSHD is bounded as described in Exhibit "B" attached hereto and forming a part hereof (the "SSHD District").

and by attaching thereto as Exhibit "B" the description attached hereto as Exhibit "B"; and

WHEREAS, The Articles of Incorporation of the South Street/Headhouse District of Philadelphia were amended on December 29, 1997 to extend the term of the Authority from five (5) years to twenty-five (25) years; and

WHEREAS, The City of Philadelphia, by Ordinance (Bill No. 970275) approved December 29, 1997, approved the Plan and Budget for the South Street/Headhouse District of Philadelphia, not including the proposed expansion, by providing in Section 3 of such Ordinance:

SECTION 3.

Is hereby declared that the participation of the Authority in projects for and concerning business improvements and administrative services to the South Street and Headhouse District areas (the "District") as contemplated in the South Street/Headhouse District Reauthorization Plan, which includes a description of the South Street Headhouse District twenty (20) year Operating Plan and Budget, and the proposed method of assessment and charges, all of which are attached as Exhibit "A," is desirable for the entire City of Philadelphia to preserve and improve the economic vitality of the District and to generate jobs for residents of the City. The South Street/Headhouse District Reauthorization Plan, having been duly reviewed and considered, is approved; and

WHEREAS, In accordance with the requirements of the Act, after sending to each property owner and commercial tenant within the existing or proposed boundaries of the district to be served by the Authority, notice of the proposed expansion to the district to be served by the Authority and a Revised Plan and Budget for the South Street/Headhouse District of Philadelphia, reflecting inclusion of the proposed expansion in the district to be served by the Authority and containing a map showing the proposed expansion to be added to the district to be served by the Authority (the "Revised Plan and Budget"), together with notice of public hearings and opportunity to comment on the amendment to the boundaries of the district to be served by the Authority and on the Revised Plan and Budget, and after due advertisement of such public hearings, public hearings have been held by the authority pursuant to the Act and legally sufficient written objections have not been received, either from persons representing the ownership of one-third of the properties in the district as proposed to be enlarged or property owners within the district as proposed to be enlarged whose property valuation as assessed for taxable purposes amounts to more than one-third of the total property valuation of the district; and

WHEREAS, The Authority has submitted to City Council for review and approval, the Revised Plan and Budget, which is attached hereto as Exhibit "C"; and

WHEREAS, City Council desires to take appropriate action with respect to the proposed amendments; now therefore

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1.

Section 1 of the Ordinance approved June 2, 1993 (Bill No. 494) is hereby amended by substituting, for the map referred to in Section 1 thereof and attached thereto as Exhibit "A," the map contained in Exhibit "D" attached hereto and hereby made a part hereof as well as the property list contained in Exhibit "E" attached hereto and hereby made a part hereof, together to set out the revision to the boundaries of the district; and Section 2 of the Ordinance approved June 2, 1993 (Bill No. 494) is hereby amended by making additions to Exhibit "B" thereto by amending Exhibit "B" attached to the extent those boundaries are expanded as indicated in the map attached hereto as Exhibit "D" and by including the additional properties indicated in the address list attached hereto as Exhibit "E."

SECTION 2.

Section 3 of the Ordinance approved December 29, 1997 (Bill No. 970275) is hereby amended by substituting, for the Plan and Budget referred to in Section 3 thereof, the Revised Plan and Budget attached hereto as Exhibit "C."

SECTION 3.

The Revised Plan and Budget, having been duly reviewed and considered, is approved.

SECTION 4.

The Clerk of City Council shall keep on file for public inspection all Exhibits referred to in this Ordinance.

SECTION 5.

This Ordinance shall take effect immediately.
