Full Bill

WHEREAS, On January 23, 1997, the City of Philadelphia, on behalf of the Philadelphia Gas Works, entered into an Assignment and Assumption of Certain Rights Under Meter and Regulator Easement (the "Assignment") with Texas Eastern Transmission Corp. ("Tetco") that shall convey to the City of Philadelphia a perpetual easement with respect to real property located at 6850 Essington avenue in Philadelphia upon approval by the Philadelphia Gas Commission and City Council; and

WHEREAS, Said Assignment was amended by the City of Philadelphia and Tetco as of January 23, 2001 by that certain First Amendment of Assignment and Assumption of Certain Rights Under Meter and Regulator Easement (the "First Amendment"); and

WHEREAS, The City of Philadelphia now desires to have the interests granted in the Assignment, as amended by the First Amendment, become perpetual interests in real property; and

WHEREAS, The Philadelphia Gas Commission at a meeting duly held on February 15, 2001, approved the Assignment, as amended, and favorably recommended the transaction to City Council; now therefore

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1.

The City Council does hereby approve the Assignment and Assumption of Certain Rights Under Meter and Regulator Easement between the City of Philadelphia and Texas Eastern Transmission Corp., dated January 23, 1997, set forth in Exhbit "A" attached hereto and made a part hereto.

SECTION 2.

The City Council does hereby approve the First Amendment of Assignment and Assumption of Certain Rights Under Meter and Regulator Easement between the City of Philadelphia and Texas Eastern Transmission Corp., dated January 23, 2001, set forth in Exhibit "B" attached hereto and made a part hereto.

SECTION 3.

The Exhibits referred to and incorporated in this Ordinance shall be kept on file by the Chief Clerk of City Council and shall be available to the public for inspection, reading or copying at reasonable times.
