THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 14 of The Philadelphia Code is amended as follows:

§14-1605.1 Telemarketing Businesses.
(1) At any location where the operation of a telemarketing business is otherwise permitted by this Code, no person shall establish, maintain or operate a telemarketing business, as that term is defined in Section 2 of the Telemarketing Registration Act, Act of December 4, 1996, P.L. 911, No. 147, without first obtaining a Zoning Board of Adjustment Certificate.
(2) This Section shall not apply to:
(a) any person excluded from the registration requirement of Section 3(a) of the Telemarketing Registration Act;
(b) any Charitable Organization, as that term is defined under Section 3 of The Solicitation of Funds for Charitable Purposes Act, Act of December 19, 1990, P.L. 1200, No. 202; or
(c) any organization specifically excluded from the definition of Charitable Organization in Section 3 of The Solicitation of Funds for Charitable Purposes Act, Act of December 19, 1990, P.L. 1200, No. 202.
(d) any location within the Fifth Councilmanic District.
