Amending Section 6-301 of The Philadelphia Code, entitled "Food Establishments," by providing for compliance with certain minimum requirements relating to the operation of take-out restaurants as a condition of obtaining or renewing a food establishment license for a take-out restaurant, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 6-301 of The Philadelphia Code is amended to read as follows:

§6-301. Food Establishments.

(2) Except as hereinafter provided in §6-305(1)(g), no person shall conduct, maintain, or operate any food establishment selling food unless he has obtained a license as provided in §6-503.

(3) Every person applying for such license shall supply such information and shall permit such inspection and examination of his food establishment and the food and persons handling food therein as the Board may by regulation prescribe to protect the health of ultimate consumers.

(a) No food establishment license shall be issued to a take-out restaurant, as that term is defined in the Zoning Code, Section 14-102, and no food establishment license shall be renewed for any such establishment, unless and until the Health Department certifies that the establishment, at the time of license issuance, meets all requirements set forth in Section 9-2002(1)(a)-(f), relating to “Sale of Malt or Brewed Beverages,” regardless whether the establishment sells any malt or brewed beverages.
