Approving a final plan for the proposed Chestnut Hill Business Improvement District ("District"), and authorizing and directing the Committee on Rules to take further actions required by the Community and Economic Improvement Act prior to enactment of an ordinance that would formally establish the District.

WHEREAS, Pursuant to Resolution No. 040045 (adopted January 22, 2004), Council initiated action to create a neighborhood improvement district in the Chestnut Hill area, to be known as the Chestnut Hill Business Improvement District (“District”), and approved a preliminary plan for the District, all as authorized by the Community and Economic Improvement Act (“Act”) (53 P.S. §18101

et seq.

); and

WHEREAS, In accordance with the Act and Resolution No. 040045, the Committee on Rules, on March 2, 2004, held a public hearing on the preliminary plan and amended it to clarify that non-commercial properties within the District would not be subject to an assessment fee; and

WHEREAS, Council now wishes to approve a final plan for the District, and to direct that further actions be taken as required by the Act prior to the enactment of Bill No. 040008, which would formally establish the District; now therefore

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA

That Council hereby approves as the final plan for the Chestnut Hill Business Improvement District (“District”) the final plan set forth in Exhibit “A” to Bill No. 040008 as amended by the Committee on Rules on March 2, 2004.

FURTHER RESOLVED, That Bill No. 040008 is hereby re-referred to the Committee on Rules, which is authorized and directed to take all further actions required by the Community and Economic Improvement Act (“Act”) prior to enactment of Bill No. 040008, which would formally establish the District, including the holding of a public hearing on the final plan. The Clerk of Council shall arrange for all mailings and publication of all notices required by the Act, as directed by the Chair of the Committee on Rules.
