Full Bill
WHEREAS, Act 45 of November 10, 1999, the Pennsylvania Construction Code Act, requires the Commonwealth Department of Labor and Industry to promulgate regulations adopting certain model codes as the Pennsylvania Uniform Construction Code ("UCC");
WHEREAS, Regulations of the Commonwealth Department of Labor and Industry adopting model codes as the UCC became effective April 9, 2004; and
WHEREAS, On December 31, 2003, the City substantially amended Title 4 of The Philadelphia Code by adopting eleven ordinances, nine of which incorporate, with changes, model international codes constituting parts of the UCC (Nos. 030772, 030773, 030775, 030776, 030777, 030778, 030779, 030781, 030782); and
WHEREAS, Act 45 requires municipalities electing to continue to administer and enforce building codes after the adoption of such regulations to adopt an ordinance formally electing to do so within the 90 day period
after
the promulgation of the Department of Labor and Industry regulations; and
WHEREAS, The City wishes to affirm that it elects to continue to administer and enforce building codes and to "opt-in" to enforcement of the UCC in Philadelphia; NOW THEREFORE
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Pursuant to Act 45 of 1999 and the regulations promulgated thereunder, the City hereby adopts the Pennsylvania Uniform Construction Code, with such modifications as are set forth in Title 4 of The Philadelphia Code, which is incorporated herein by reference, and elects to enforce and administer the UCC.
SECTION 2. Administration and enforcement of the UCC shall be undertaken by such City officials and employees as provided in the Philadelphia Home Rule Charter and The Philadelphia Code.
