THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

(1) Definitions.
(a) Electric Personal Assistive Mobility Device or EPAMD. This term has the same meaning as defined under 75 Pa. C.S.A. §102.
(2) Prohibited Conduct. No person shall operate an Electric Personal
Assistive Mobility Device (EPAMD) in any of the following areas:
(a) on any sidewalk or sidewalk area;
(b) on any public property, other than sidewalks or sidewalk areas,
unless the use of an EPAMD is authorized by regulation, ordinance, statute or by the governmental agency, department or commission responsible for such property; or
(c) on private property without the permission of the owner.
(3) The parent, legal guardian, or other adult legally responsible for
any child under the age of eighteen (18) years who violates this Section shall also be in violation of this Section.
(4) This Section does not prohibit the operation of an EPAMD by a person with a mobility related disability.
(5) The penalty for a violation of this Section shall be a civil
penalty of no less than three hundred (300) dollars, provided that the total amount of civil penalties assessed against a child and his or her parents shall not exceed a total of three hundred (300) dollars based upon each violation by the child.
(6) Enforcement. A police officer may issue a ticket to any person in
violation of this Section pursuant to the procedures set forth in § 10-1606. Contested charges shall be resolved, fines shall be imposed, and payments shall be collected and processed by the Director of Finance and the Bureau of Administrative Adjudication, all pursuant to the procedures set forth in §§ 10-1604 through 10-1610.
