Amending Section 14-1627 of The Philadelphia Code, entitled "Gambling Establishments," which provides that licensed gambling establishments are not a permitted use unless specifically approved by ordinance, by lifting the three year "sunset" clause so as to make the provisions of Section 14-1627 apply permanently within the Penn's Landing area, defined as the area bounded by Columbus Boulevard, the Delaware River, Washington Street and Spring Garden Street, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 14-1627 of The Philadelphia Code is hereby amended to read as follows:

§14-1627. Gambling Establishments.

(1) The conducting of licensed gambling operations, other than those licensed under the Local Option Small Games of Chance Act (10 P.S. §311 et seq.), shall not be a permitted use in any zoning district within the City, unless such use is expressly permitted by ordinance.

(2) No variance shall be granted from this Section except where the denial of a variance would effect an unconstitutional taking.

(3) The provisions of this Section shall expire three years after the date this Section became law

, except with respect to the following areas, in which the provisions of this Section shall be permanent:

(a) Penn's Landing, defined as the area bounded by Columbus Boulevard, the Delaware River, Washington Street and Spring Garden Street
