Amending the Ordinance approved June 28, 1966 (Bill No. 1845), as amended, known as the "Philadelphia Housing Development Agreement Ordinance," and entitled "An Ordinance authorizing the Commissioner of Public Property on behalf of the City to enter into an agreement with the Philadelphia Housing Development Corporation to provide for low cost residential development and redevelopment in the City and to cooperate in certain housing programs, including the transfer of certain parcels of land, under certain terms and conditions," by requiring the express approval of Council by ordinance prior to the transfer of any City-owned property pursuant to that Ordinance or pursuant to the agreement authorized by that Ordinance.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 2 of the Ordinance approved June 28, 1966 (Bill No. 1845), known as the “Philadelphia Housing Development Agreement Ordinance,” is amended by adding a new paragraph, as follows:

21.

Nothing in this agreement shall be construed to constitute Council’s approval of the transfer of any City-owned property to PHDC or to any other party, and no City-owned property shall be transferred to PHDC or to any other party pursuant to this agreement without the express approval of Council by resolution.

SECTION 2.

The Ordinance approved June 28, 1966 (Bill No. 1845), known as the “Philadelphia Housing Development Agreement Ordinance,” is further amended by adding a new Section 5, to read as follows:

SECTION 5.

Nothing in this Ordinance shall be construed to constitute Council’s approval of the transfer of any City-owned property to PHDC or to any other party, and no City-owned property shall be transferred to PHDC or to any other party pursuant to this Ordinance or pursuant to the agreement authorized by this Ordinance without the express approval of Council by resolution.
