Full Bill

WHEREAS, The Department of Commerce is willing to accept an application from the owners of a property in the 65th ward of the City, in the vicinity of the Delaware River, and more particularly described in Exhibit “A” hereto (the “Property”), and from all parties with any known interest in the Property, including any prospective purchasers of the Property, requesting and consenting to the removal of all exemptions, deductions, abatements, or credits provided for by Chapter 19-3200 of The Philadelphia Code, relating to the Keystone Opportunity Zone, with respect to the Property, all to enable a residential development on the Property.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Any exemptions, deductions, abatements or credits provided for by Chapter 19-3200 of The Philadelphia Code, relating to the Keystone Opportunity Zone, with respect to a portion of a property in the 65th ward of the City, in the vicinity of the Delaware River, more particularly described in Exhibit “A” hereto (the “Property”), are hereby repealed, revoked and removed; and the Property is hereby removed from the Philadelphia Keystone Opportunity Zone.

SECTION 2. The repeal, revocation and removal described in Section 1 of this Ordinance shall be effective upon, and only with respect to exemptions, deductions, abatements or credits accruing on or after, the effective date of an approval by the Commonwealth Department of Community and Economic Development (the “Department”) of a request by the Director of Commerce to decertify the Property and remove it from the Philadelphia Keystone Opportunity Zone, which request shall not be submitted with respect to any portion of the Property prior to the submission by the owners and all parties with any known interest in said portion of the Properties of written application to the Department of Commerce requesting and consenting to the removal of all exemptions, deductions, abatements, or credits provided for by Chapter 19-3200 of The Philadelphia Code, relating to the Keystone Opportunity Zone with respect to said Property. To the extent the Department approves the decertification of less than all of the Property, the repeal, revocation and removal provided for in Section 1 of this Ordinance shall be effective only with respect to such portion of the Property as the Department approves for decertification.

SECTION 3. The Clerk shall keep on file for public inspection a copy of all Exhibits referenced herein.

Exhibit “A”

Description of Property

Residential Premises (KOZ)

All that certain tract, piece or parcel of land with the improvements thereon

erected, situated in the 65th ward of the city of Philadelphia and described as

follows to wit:

Beginning at an interior point; point being measured the following six (6)

courses and distances from a point of tangent measured Northwardly on the

arc of a circle curving to the right connecting the Southeasterly side of State

Road (80 feet wide) with the Northeasterly side of Bleigh avenue (variable

width) having a radius of 15.295 feet and an arc distance of 26.688 feet from a

point of curve on the said Northeasterly side of Bleigh avenue;

1. North 55 degrees 55 minutes 41 seconds East, along the

Southeasterly side of said State road 1,976.280 feet;

2. THENCE extending continuing along the Southeasterly side of

said state road (80 feet wide) North 55 degrees 55 minutes 41

seconds East, 98.684 feet to a point;

3. THENCE extending North 55 degrees 55 minutes 41 degrees East

24.000 feet to a point on the Northeasterly side of a 24 foot right of

way for ingress and egress and the Northeasterly side of a 60 foot

right of way for sewer and water main purposes;

4. THENCE extending South 34 degrees 12 minutes 22 seconds East

along the Northeasterly side of the 24 foot wide easement and the

Northeasterly side of a 60 foot right of way for sewer and water

main purposes 165.165 feet to a point on the Westerly side of an

aerial easement for the Delaware expressway interstate 95

(159.601 feet wide);

5. THENCE extending South 34 degrees 12 minutes 22 seconds East,

along the Northeasterly side of the 24 foot easement and the 60

foot wide right of way, through the bed of the aerial easement for

interstate 95, 193.290 feet to a point on the Easterly side of the

aerial easement for interstate 95;

6. THENCE extending South 34 degrees 12 minutes 22 seconds East

along the Northeasterly side of the 60 foot right of way and

partially along the Northeasterly side of the 24 foot right of way

944.990 feet to the point of beginning;

THENCE from said point of beginning continuing along the Northeasterly

side of the 60 foot right of way and partially along the Northeasterly side of

the 24 foot right of way South 34 degrees 12 minutes 22 seconds East,

1765.652 feet to a point on the bulkhead line of the Delaware river established

by the secretary of war September 10, 1940;

THENCE continuing along the said side of the 60 foot wide right of way

South 34 degrees 12 minutes 22 seconds East 299.685 feet to a point on the

Pierhead line of the Delaware river established by the secretary of war

September 10, 1940;

THENCE extending along the Pierhead line of the Delaware River the

following two (2) courses and distances:

1. South 52 degrees 42 minutes 41 seconds West, 533.414 feet to an

angle point;

2. South 69 degrees 24 minutes 38 seconds West, 837.490 feet to a

point;

THENCE extending North 32 degrees 39 minutes 35 seconds West 306.032

feet to a point on the bulkhead line of the Delaware River;

THENCE extending North 32 degrees 39 minutes 35 seconds West 570.626

feet to a point;

THENCE extending North 66 degrees 13 minutes 00 seconds East 151.819

feet to a point;

THENCE continuing North 32 degrees 39 minutes 35 seconds West, 420.200

feet to a point;

THENCE extending North 32 degrees 39 minutes 35 seconds West, 444.044

feet to a point;

THENCE extending North 57 degrees 48 minutes 28 seconds East, 464.617

feet to a point;

THENCE extending North 34 degrees 10 minutes 38 seconds West, 471.012

feet to a point;

THENCE extending North 55 degrees 47 minutes 38 seconds East, 153.162

feet to a point;

THENCE extending South 34 degrees 12 minutes 22 seconds East, 120.698

feet to a point;

THENCE extending North 55 degrees 47 minutes 38 seconds East, 131.372

feet to a point;

THENCE extending South 34 degrees 12 minutes 22 seconds East, 149.925

feet to a point;
