Full Bill

WHEREAS, Under Section 6 of the First Class City Home Rule Act (53 P.S. §13106), an amendment to the Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now, therefore,

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA,

That the following amendment to the Philadelphia Home Rule Charter is hereby proposed and shall be submitted to the electors of the City on an election date designated by ordinance:

§3-911. Zoning Board of Adjustment.

The Zoning Board of Adjustment shall be composed of five appointed members and the Commissioner of Licenses and Inspections.

The five appointed members shall be comprised of an architect, an urban planner, a traffic engineer, an attorney experienced in land use issues, and a representative of Philadelphia community groups

that participate in land use issues.

§A-200. Schedule.

(7) The amendment to Section 3-911 of this Charter providing for the composition of the Zoning Board of Adjustment shall take effect January 7, 2008. Members of the Zoning Board of Adjustment who hold office on January 6, 2008 shall continue to hold office until their successors have been appointed, provided that the Mayor may reappoint any such member who meets one of the required categories of membership set forth in amended Section 3-911.
