WHEREAS, Pursuant to Resolution No. 070024 (adopted January 23, 2007), Council initiated action to create a neighborhood improvement district in the Mt. Airy area, to be known as the Mt. Airy Business Improvement District (“District”), and approved a preliminary plan for the District, all as authorized by the Community and Economic Improvement Act (“Act”) (53 P.S. §18101
et seq.
); and
WHEREAS, In accordance with the Act and Resolution No. 070024, the Committee on Rules, on March 14, 2007, held a public hearing on the preliminary plan and amended it to clarify that four properties on the list of properties to be assessed, as set forth in Exhibit A-2 of the plan, would be removed from the list and would not be assessed; and
WHEREAS, Council now wishes to approve a final plan for the District, and to direct that further actions be taken as required by the Act prior to the enactment of Bill No. 070005, which would formally establish the District; now therefore
RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA

That Council hereby approves as the final plan for the Mt. Airy Business Improvement District (“District”) the final plan set forth in Exhibit “A” to Bill No. 070005 as amended by the Committee on Rules on March 14, 2007.
FURTHER RESOLVED, That Bill No. 070005 is hereby re-referred to the Committee on Rules, which is authorized and directed to take all further actions required by the Community and Economic Improvement Act (“Act”) prior to enactment of Bill No. 070005, which would formally establish the District, including the holding of a public hearing on the final plan. The Clerk of Council shall arrange for all mailings and publication of all notices required by the Act, as directed by the Chair of the Committee on Rules.
