Amending Section 14-1605 of The Philadelphia Code, entitled "Regulated Uses," by providing for Special Regulated Uses, prohibiting such uses in the vicinity of certain residentially related uses, and designating overflow storage tanks as a special regulated use, all under certain terms and conditions.
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Section 14-1605 of The Philadelphia Code is amended to read as follows:
§ 14-1605. Regulated Uses.
(1) Legislative Findings. The Council finds that:

(f) Certain uses are particularly inappropriate in or around residential neighborhoods and residentially related uses, because of, for example, deleterious health, safety or environmental effects.

(3.1) Special regulated uses. The following uses are designated as special regulated uses:
(a) Sewage overflow tanks, for collection and storage of dilute sewage for a short period of time prior to release of the sewage to the treatment plant, but not including any tank used for collection and storage of sewage only from an individual property.

(4.1) Additional prohibited conduct. Within the Sixth and Tenth Councilmanic Districts, no special regulated use shall be permitted:
(a) Within one thousand five hundred feet (1,500') of any residentially zoned district (regardless of the actual uses contained therein).
