Amending Bill No. 070263 (approved September 20, 2007), entitled "An Ordinance authorizing Northern Star Developments LLC, 5 Eiker Road, Cranberry, NJ 08512, owner of the property at 1617 N. 2nd Street, Philadelphia, PA 19122, to construct, own and maintain multi-level bays and balconies as part of the Oxford Mews residential development project, under certain terms and conditions," by providing that the Bill shall take effect immediately, and by extending the time for compliance with the conditions stated therein.

Full Bill

WHEREAS, Bill No. 070263 (approved September 20, 2007), conditionally authorized certain encroachments at a property owned by Northern Star Developments LLC located at 1617 N. 2nd Street, Philadelphia, PA 19122; and

WHEREAS, Section 6 of Bill No. 070263 provided that the Bill would not be effective unless $200 in costs was paid into the City Treasury within sixty days after the date the Bill became law, but due to an excusable oversight, that requirement was not met; and

WHEREAS, The party in interest has now paid $200 in costs into the City Treasury; now, therefore

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Bill No. 070263 (approved September 20, 2007) is hereby amended by deleting Sections 5 and 6 in their entirety, and by adding new Sections 5 and 6, to read as follows:

SECTION 5. The permission granted to Northern Star Developments LLC to construct, own and maintain the multi-level bays and balconies described in Section 1 shall expire without any further action by the City of Philadelphia if Northern Star Developments LLC has not entered into an Agreement and satisfied all requirements of the Agreement that are listed in Section 3 of this Ordinance by December 31, 2008.

SECTION 6. This Ordinance shall take effect immediately.
