Full Bill

WHEREAS,

Section 15(3) of the Fiscal Year 2008 Operating Budget Ordinance (Bill No. 070116-AA, approved June 22, 2007) provides that if “pursuant to the provisions of Section 8-401 of the Philadelphia Home Rule Charter, employees of any office, department, board or commission are used by another office, department, board or commission, the compensation of such employees for the period of such use may not be charged against the applicable appropriations to the using office, department, board or commission, unless Council by ordinance expressly approves such charge”; and

WHEREAS,

Pursuant to Section 8-401 of the Charter, the District Attorney, with the approval of the Police Commissioner, is using employees of the Police Department to carry out certain powers and duties of her Office; and

WHEREAS,

The Director of Finance, with the approval of the Police Commissioner and the District Attorney, would like to charge the compensation of such Police Department employees against appropriations made to the District Attorney in the Fiscal Year 2008 Operating Budget Ordinance; now, therefore

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Pursuant to Section 15(3) of Bill No. 070116-AA (approved June 22, 2007), the Finance Director is hereby authorized to charge against appropriations made to the District Attorney in the Fiscal Year 2008 Operating Budget Ordinance, the compensation of Police Department employees being used by the District Attorney pursuant to Section 8-401 of the Philadelphia Home Rule Charter, in an amount not to exceed $5.0 million. Within one week of taking any action authorized by this Ordinance, the Director of Finance shall provide written notice to the President and all members of Council, with a copy to the Chief Clerk of Council, detailing such action.
