THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

(1) Definitions.
(a) Donation drop-off bin. A container or bin used for the purpose of receiving donations of clothing or household items for retrieval by the container or bin owner or user.
(2) Prohibited and required conduct.
(a) No person shall place or maintain a donation drop-off bin in a location accessible to the general public, or permit such placement of a donation drop-off bin on his or her property, unless a permit issued by the Department of Licenses and Inspections has been obtained in connection with placement of the bin and such permit is affixed to the bin.
(b) Any person who has placed a donation drop-off bin in a location accessible to the general public, or permitted placement of a donation drop-off bin on his or her property, shall:
(i) ensure that the bin is emptied at least once per week; and
(ii) keep the area around the bin clean and free from overflowing donations of clothing or other household items.
(3) Donation drop-off bin permit.
(a) An application for a donation drop-off bin permit shall be made to the Department of Licenses and Inspections and shall include:
(1) the name, address and telephone number of the person applying for the permit;
(2) the proposed address and precise location where the bin is to be placed;
(3) the name, address and telephone number of the property owner, or his or her agent, of the location where the bin is to be placed, if such person is different than the applicant himself;
(4) the name, address and phone number of the person who will be placing the bin, if such person is different from the applicant himself; and
(5) information as to the manner in which the bin is to be emptied or removed, including the removal schedule, and the destination of the clothing and or household items to be removed from the bin.
(b) No permit shall be granted for the placement of a donation drop-off bin in the public right-of-way unless the Streets Department approves such placement based on a determination that placement in the right-of-way will not unreasonably impede public use of the right-of-way.
(c) The annual fee for a donation drop-off bin shall be thirty-five (35) dollars.
