Amending Section 12-902 of The Philadelphia Code, entitled "Parking for Certain Purposes Prohibited," by prohibiting the standing or parking of any boat on the roadway for the purpose of sale, washing, greasing or repairing and amending Section 12-2405, entitled "Removal or Immobilization of Parked Vehicles; Notice," to provide for towing of boats parked for the purpose of sale and Section 12-2809, entitled "Civil Penalties and Costs," to provide for penalties for violations; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 12-902 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-900. PARKING REGULATIONS AND PENALTIES.

§ 12-902. Parking for Certain Purposes Prohibited.

(1) No person shall stand or park a vehicle

or boat

upon any roadway for the purpose of:

(a) Displaying such vehicle

or boat

for sale;

(b) Commercial washing, greasing or repairing such vehicle

or boat

except repairs

may be made to such a vehicle when

necessitated by an emergency.

SECTION 2. Section 12-2405 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-2400. TOWING AND IMMOBILIZING OF PARKED OR ABANDONED VEHICLES.

§ 12-2405. Removal or Immobilization of Parked Vehicles; Notice.

(1) Any vehicle may be removed, by means of towing to the nearest Official Towing Station or immobilized for up to seventy-two (72) hours by means of applying a boot and then towed to the nearest Official Towing Station if not reclaimed, by or under the direction of a member of the Department, or its designated agent whenever any vehicle is:

(f) parked in violation of Section 12-902(1)(a), which prohibits the parking of a vehicle

or boat

upon any roadway for the purpose of displaying such vehicle

or boat

for sale; or

SECTION 3. Section 12-2809 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-2800. ADMINISTRATIVE ADJUDICATION OF PARKING VIOLATIONS.

§ 12-2809. Civil Penalties and Costs.

* * *

(2) Any person violating the following provisions of Title 12 shall, upon a final finding of liability pursuant to this Chapter 12-2800, be liable for payment of the civil penalty indicated, in addition to the costs and fees set forth in subsection 12-2809(1):
