THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

(1) No person shall sell foie gras within the City of Philadelphia.
(2) For purposes of this section:
(a) Foie gras means any food containing the liver of a bird, which has been enlarged beyond normal size through forced feeding.
(b) A bird means any member of the avian family, including but not limited to a duck or goose.
(c) Forced feeding means causing a bird to ingest an excessive quantity of food, or more food than a typical bird of the same species would consume voluntarily while foraging. Force feeding methods include, but are not limited to, delivering feed through a tube or other device inserted into the bird's esophagus.
(3) Violations of this section are Class II offenses subject to the penalties provided in §1-109.
