THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS

(4) Every person required to procure a license under this Section shall as a condition to the receipt or retention of the license:

(h) With respect to persons operating a “food service establishment,” as defined in Section 6-102, in addition to the other requirements of this Section, the owner or manager, or agents of such owner or manager, of the food service establishment shall:
(.1) In the event of the occurrence of a violent crime, or threat of imminent occurrence of a violent crime, on the premises or in the immediate vicinity of the food service establishment, promptly call 911 and provide the pertinent information necessary for police to respond to the incident;
(.2) In the event of a police investigation of the occurrence of a violent crime on the premises or in the immediate vicinity of the food service establishment, cooperate fully with the police, including but not limited to taking the following actions:
(.a) Provide lists of all employees of the food service establishment and any known witnesses to the crime, and encourage employees and witnesses to respond to police inquiries concerning the crime;
(.b) Make any video surveillance tapes relevant to the commission of the crime available to the police;
(.c) Make any identification scanner databases for the relevant time period available to police;
(.d) Allow the police full access to the premises and immediate vicinity of the establishment for purposes of gathering any physical evidence or otherwise conducting the investigation; and
(.e) Refrain from taking any actions that would have the effect of obstructing a police investigation of the commission of a violent crime on or near the premises of the food service establishment.

The Department of Licenses and Inspections is authorized to deny or revoke a business privilege license for failure to comply with the requirements of this subsection. Any person who has been denied a license or whose license has been revoked shall have the right to appeal to the Board of License and Inspection Review within ten (10) days after receipt of the notice of denial or revocation.
