THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1

. The Commissioner of Public Property, on behalf of the City of Philadelphia, is hereby authorized to enter into an agreement (“Lease”) to lease certain City owned property known as the Lincoln Financial Mural Arts Center at the Thomas Eakins House located at 1729 Mt. Vernon Street (“Property”) to the Philadelphia Authority for Industrial Development (“PAID”), for further sublease by PAID to the Mural Arts Advocates, a 501 (c) (3) created to support the work of the City of Philadelphia Mural Arts Program.

SECTION 2

. The Lease shall be for an initial term of ten (10) years with an option to renew for two (2) additional five (5) year terms. The City shall be responsible for the payment of utilities, janitorial services and maintenance of the Property. The Property may only be used for the City of Philadelphia Mural Arts Program and for no other purposes.

SECTION 3

. The City Solicitor is hereby authorized to review and to approve the Lease and other documents necessary to effectuate this Ordinance, which Lease and documents shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City of Philadelphia and carry out the purpose of this Ordinance.
