Amending Chapter 12-900 of The Traffic Code, entitled "Parking Regulations and Penalties," and amending Chapter 9-600 of The Philadelphia Code, entitled "Service and Other Businesses," to increase the available off-street options for the parking of motor-driven cycles; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 12-900 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 12-900. PARKING REGULATIONS AND PENALTIES.

§ 12-913. Prohibitions in Specified Places.

(1) Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle or in compliance with law or the directions of a police officer or official traffic-control device, no person shall:

(a) Stop, stand or park a vehicle:

(ii) On a sidewalk except that a bicycle may be parked as provided in Section 12-807

and that a motor-driven cycle may be parked as provided in Section 12-920

.

§ 12-920. Parking of Motor-Driven Cycles on Sidewalks.

A person may park and secure a motor-driven cycle upon the sidewalk in a rack designed to support a motor-driven cycle, or against a building or at the curb, in such a manner as to afford the least obstruction to pedestrian traffic.

SECTION 2. Chapter 9-600 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 9-600. SERVICE AND OTHER BUSINESSES.

[(h) Parking of Certain Vehicles Refused. Any licensee shall have the right to refuse to accept for parking any vehicle which could, in the opinion of the licensee or his employees constitute a hazard, nuisance or danger to other vehicles or persons or property within the parking lot.]

(10) Parking of Certain Vehicles Refused.

Any Public Parking Lot, Public Garage, Valet Parking Operator or Employer-Provided Parking Facility shall have the right to refuse to accept for parking any vehicle which could, in the opinion of the Public Parking Lot, Public Garage, Valet Parking Operator, Employer-Provided Parking Facility or his employees constitute a hazard, nuisance or danger to other vehicles or persons or property within the parking lot or garage; provided that no Public Parking Lot, Public Garage, Valet Parking Operator or Employer-Provided Parking Facility shall categorically refuse to accept for parking motorcycles or motor-driven cycles.

SECTION 3. Section 1 of this Ordinance shall take effect only upon the enactment of authorizing legislation by the Pennsylvania General Assembly. Section 2 of this Ordinance shall take effect immediately upon becoming law.
