THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 17-109 of The Philadelphia Code is amended to read as follows:

§ 17-109. Local Bidding Preferences.

(5) Award of City Contracts.

(a) On any contract for which the City secures competitive bids pursuant to Section 8- 200(1) of the Home Rule Charter, the Commissioner shall award a five percent bid preference to any Local Business Entity that submits with its bid:

(b) In determining the lowest responsible bidder on any such contract, the Commissioner shall subtract five percent from the bid of any Local Business Entity awarded such a preference

When there is a responsive bid from a local business entity within 10% of the lowest price submitted by a responsive non-local business, the local business shall have the opportunity to submit a bid equal to or lower than the amount of the low bid previously submitted by the non-local business. The Commissioner

shall

otherwise

implement the bid preference [otherwise] pursuant to regulations promulgated by the Commissioner.

The local preference must be applied to all price quotations at the time of price submittals.
