Amending Section 14-908 of The Philadelphia Code, entitled "Queen Village Neighborhood Conservation District," by deleting the provision which provided for the expiration of Section 14-908 one year after it became law, thereby reestablishing on a permanent basis the Queen Village Neighborhood Conservation District, under certain terms and conditions.

Full Bill

WHEREAS, Bill No. 080080-A (approved July 15, 2008) added Section 14-908 to The Philadelphia Code (“Code”) and thereby created the Queen Village Neighborhood Conservation District (“District”) in accordance with the provisions of Section 14-903 of the Code, which sets forth the procedures for creating a Neighborhood Conservation District; and

WHEREAS, Section 14-908 of the Code contained a sunset provision that the District would expire one year after the date that Section became law, the date of expiration being July 15, 2009; and

WHEREAS, As a result of the sunset provision in Section 14-908 of the Code, the District expired on July 15, 2009 and has been out of existence since that date; and

WHEREAS, The purpose and intent of this Ordinance is to reestablish the District permanently under the terms and conditions now set forth in Section 14-908 of the Code, without repeating any of the procedures that might otherwise be required by Section 14-903 for creation of a new Neighborhood Conservation District, or for amendment of an existing such District; now, therefore

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 14 of The Philadelphia Code is hereby amended to read as follows:

TITLE 14. ZONING AND PLANNING.

CHAPTER 14-900. NEIGHBORHOOD CONSERVATION DISTRICTS.

* * *

§ 14-908. Queen Village Neighborhood Conservation District.

* * *

[(7) The provisions of this Section shall expire one year after the date that this Section becomes law.]

SECTION 2. This Ordinance shall be effective immediately, notwithstanding any contrary provisions of Section 14-903 of The Philadelphia Code, relating to the creation and amendment of Neighborhood Conservation Districts.
