THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 17-100 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 17-100. PROCUREMENT CONTRACTS.

§17-112. Reimbursement of Diesel Emission Reduction Expenses.

If any City bid specification requires a vendor to use only vehicles designed or retrofitted to reduce diesel emissions, then any contract resulting from such bid shall contain a provision under which the City pays the vendor for the cost of retrofitting those vehicles used to provide services under the contract. The Procurement Department shall determine a standard reimbursement rate for each type of vehicle, and may specify the documents a vendor must submit to prove that a retrofit was completed. A vendor shall be eligible for such reimbursement regardless of when a vehicle was retrofitted, even if the retrofit was completed before the City bid was issued, provided that no vendor shall receive reimbursement for retrofitting any particular vehicle more than once.
