Amending Chapter 9-200 of The Philadelphia Code, entitled "Commercial Activities on Streets," by amending Section 9-203, entitled "Street Vendors," and Section 9-205, entitled "Sidewalk Sales," by prohibiting street vending and sidewalk sales within the area bounded by and including both sides of E. Tioga Street, Kensington Avenue, E. Ontario Street, Potter Street, "I" Street, E. Westmoreland Street, "F" Street, Kensington Avenue, E. Monmouth Street, and Emerald Street, providing for certain exceptions and making certain technical changes, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 9-200 of The Philadelphia Code is hereby amended to read as follows:

CHAPTER 9-200. COMMERCIAL ACTIVITIES ON STREETS.

§9-205. Sidewalk Sales.

* * *

(8) Prohibited Conduct. No vendor or person shall:

* * *

(p) exhibit, display, offer for sale or sell any goods, wares, or merchandise or place or allow any stand to remain on the sidewalks of the following streets or any other location which the Council shall from time to time ordain:

(.20) [ East side of Kensington avenue, between Allegheny avenue and Hilton street;]

Within the area bounded by and including both sides of E.

Tioga street, Kensington avenue, E. Ontario street, Potter street, "I" street, E. Westmoreland street, "F" street, Kensington avenue, E. Monmouth street, and Emerald street,

except that sidewalk sales shall be permitted, by the owner or tenant of a building, on the sidewalk immediately adjacent to such building, up to a distance of three (3) feet from the building line, provided such sales are accessory to the business conducted by the owner or tenant in the abutting building and a free and clear distance of at least six (6) feet is maintained for pedestrian travel. Such building owners or their tenants shall comply with all provisions of Section 9-205, including but not limited to, the license requirements of subsection (3);

[(.27) East and west sides of Kensington avenue, between Orleans street and the south side of Allegheny avenue;]

[(.49) Allegheny avenue, both sides between Jasper street and "G" street except that sidewalk sales shall be permitted on the north side of Allegheny avenue from a point between Kensington avenue and a point fifty feet east of the east curb of Kensington avenue;]

[(54) East and west sides of the 3200 and 3300 block of Kensington avenue;]

[(.80) The east side of Kensington avenue between Orleans street and Clearfield street;

(.81) The south side of Clearfield street between Kensington avenue and Ruth street;]

[(.197) North side of Clearfield street between Kensington avenue and Ruth street;]

* * *

[(.290) 800 block and 1800 block of East Allegheny avenue;

(.291) 3200 block of "H" street;]

SECTION 2. The provisions of Section 9-205 shall be renumbered to reflect the deletions of certain subsections.

SECTION 3. This Ordinance shall take effect immediately.
