Amending Section 21-1702 of The Philadelphia Code, entitled "Notice of Certain Procurement Contracts Available for Bid," by adding new requirements for providing notices of certain sealed bids to community-based newspapers, registered community development corporations and nonprofit civic associations; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Section 21-1702 of The Philadelphia Code is hereby amended to read as follows:

§ 21-1702. Notice of Certain Procurement Contracts Available for Bid.

(2) The following notice requirement applies to any purchase or contract for which competitive bidding is required pursuant to Section 8-200(1) of the Charter and which is subject to Section 8-200(2) of the Charter:

(a) The Procurement Department

(“Department”)

shall advertise for sealed bids at least once a week for two weeks in one of the three newspapers having the largest paid circulation in the City and in such other newspapers as it deems necessary, provided that if no newspaper having a paid circulation in the City is then publishing, notice shall be published on the City's official website, or in such other manner as designated by the Finance Director.

If a sealed bid, in whole or in part, is for work to be performed at a particular location, the Department shall also advertise for sealed bids at least once a week for two weeks in at least one community-based newspaper which serves the neighborhood where the work is to be performed.

(b) If a sealed bid, in whole or in part, is for work to be performed at a particular location, the Department, on or before the day that its sealed bid advertisement is first published pursuant to subsection (a), shall send notice of each contract available for sealed bid to any community development corporation or nonprofit civic association which is registered with the Department and whose defined geographical boundary in the case of a community development corporation, or whose defined membership boundary, in the case of a nonprofit civic association, includes the zip code where the work is to be performed. Required notices shall be sent to each registered organization via electronic mail, unless the organization files a certification with the Department declaring that no one associated with the organization has regular and reliable access to email. Upon receipt of such certification, the Department shall send each notice to that organization via first class United States mail.

(i) Any organization which desires to receive notice of sealed bids under this subsection must register with the Department. Before the Department will accept an organization's registration, the organization must:

(A) demonstrate that the organization is either a recognized community development corporation within a defined geographical area or is a recognized nonprofit civic association with a defined membership boundary;

(B) demonstrate that the organization's mission is to promote the general welfare; and

(C) provide to the Department a list of the zip codes which comprise its defined geographical area or defined membership boundary area.

) In addition, such other notice may be given as will bring purchase or contract opportunities to the attention of interested bidders.

SECTION 2. Effective Date. This Ordinance shall take effect four (4) months after it becomes law, provided that the Procurement Department is authorized to promulgate any regulations and take any other actions needed to prepare for implementation of this Ordinance immediately after this Ordinance becomes law.
