Full Bill

WHEREAS, The City of Philadelphia and certain Airlines providing regularly scheduled service to Philadelphia International Airport entered into a certain Airport-Airline Use and Lease Agreement effective July 1, 2007 and terminating June 30, 2011. Bill No. 070220 authorizing this agreement was passed by City Council on May 31, 2007 and signed by Mayor Street on June 13, 2007; and

WHEREAS, The City of Philadelphia and certain airlines wish to extend the Airport-Airline Use and Lease Agreement under virtually identical provisions effective July 1, 2011 and terminating June 30, 2013 and to add certain Pre-Approved Capital Improvement Programs to Exhibit “E”; now, therefore

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The Department of Commerce, acting through the Director of Commerce and the Deputy Mayor, Transportation & Utilities, on behalf of the City of Philadelphia, is hereby authorized to enter into and execute a certain Airport-Airline Use and Lease Agreement Extension in substantially the form attached hereto as Exhibit “1” (hereinafter, “Agreement Extension”) with each airline providing regular scheduled service to Philadelphia International Airport (or which shall in the future provide such regularly scheduled service) that agrees to meet the terms and conditions contained therein.

SECTION 2. The Airlines shall have the use and occupancy of the space as set forth in the individual Exhibits to the existing Airport-Airline Use and Lease Agreement (“Agreement”) and the Airlines shall pay the rents, rates, and charges for such space and at such times, in accordance with the formulae and in the manner set forth in the Agreement.

SECTION 3. The Department of Commerce is authorized to take all further actions as may be necessary in order to accomplish the intent and purpose of this Ordinance.

SECTION 4. The City Solicitor is hereby authorized to include in the Agreement Extension such other terms and provisions as she shall deem necessary or appropriate to protect the interests of the City.

SECTION 5. The existing Agreement is attached hereto for reference, as Exhibit “2.” The Chief Clerk shall keep on file a copy of Exhibit “2” and shall make it available for inspection by the public during regular business hours.
