Amending Title 21 of The Philadelphia Code, entitled "Miscellaneous," by regulating the public availability of police accident reports, including, but not limited to, providing for the confidentiality of certain information contained in such reports, and providing fees for the issuance of such reports, all under certain terms and conditions.
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1. Title 21 of The Philadelphia Code is hereby amended to read as follows:
TITLE 21. MISCELLANEOUS.

CHAPTER 21-2000. POLICE ACCIDENT REPORTS.
§21-2001. Confidentiality.
(1) Except as provided in paragraph (2), a written police report pertaining to a motor vehicle accident shall be confidential and shall not be made available to the public.
(2) The provisions of §21-2001 shall not apply to any person who is required to be furnished a copy of a police accident report upon request, pursuant to 75 Pa.C.S. §3751(b).
§21-2002. Fees.
The fee for providing a copy of a police accident report, or for providing information from such report, shall be $25.
SECTION 2. Effective Date. This Ordinance shall take effect upon the adoption of implementing regulations by the Department of Records, but in no event later than 45 days from the date it is approved.
