Proposing an amendment to The Philadelphia Home Rule Charter relating to the "resign to run" requirement to provide that, as of the date specified, no person who holds an elective public office other than a City office may be a candidate for any City office unless that person first resigns his or her elective office, all for the purpose of leveling the playing field for elected City officials, who are required by the Charter to resign before seeking any public office other than the office currently held; and providing for the submission of the amendment to the electors of Philadelphia.

Full Bill

WHEREAS, Under Section 6 of the First Class City Home Rule Act (53 P.S. §13106), an amendment to The Philadelphia Home Rule Charter may be proposed by a resolution of the Council of the City of Philadelphia adopted with the concurrence of two-thirds of its elected members; now therefore

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That the following amendment to The Philadelphia Home Rule Charter is hereby proposed and shall be submitted to the electors of the City on an election date designated by ordinance:

ARTICLE X

PROHIBITED ACTIVITIES OF COUNCILMEN, CITY OFFICERS, EMPLOYEES AND OTHERS, AND PENALTIES

§10-107. Political Activities.

(5) No officer or employee of the City, except elected officers running for re-election, shall be a candidate for nomination or election to any public office unless he shall have first resigned from his then office or employment.

(6) No person holding any elective public office other than a City office shall be a candidate for nomination or election to any City office unless he shall have first resigned from his then office.

Any officer or employee of the City who violates any of the foregoing provisions of this section shall, in addition to any penalties provided for hereafter, be ineligible for one year for any office or position under the City.

This charter shall become effective on the first Monday of January, 1952, except in the following particulars:

(10) The amendment to this Charter re-numbering the original subsection 10-107(6) to 10-107(7) and adding a new subsection 10-107(6) relating to a requirement that persons holding elective public office other than a City office resign before becoming a candidate for City office, shall take effect January 1, 2013.
