THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The Commissioner of Public Property, on behalf of the City of Philadelphia, is authorized to acquire by lease or by deed up to 23 acres of land in the area bounded by the Delaware River, the former Frankford Creek, Bridge Street, Tacony Street and Darkrun Lane (extended to the Delaware River) from the Pennsylvania Fish and Boat Commission (“Fish & Boat”) with respect to those acres owned by Fish & Boat and from the Philadelphia Authority for Industrial Development (“PAID”) with respect to those acres owned by PAID, all for nominal consideration.

SECTION 2. The Commissioner of Public Property, on behalf of the City of Philadelphia, is authorized to convey up to 10 acres of land in the area bounded by the Delaware River, the former Frankford Creek, Bridge Street, Tacony Street and Darkrun Lane (extended to the Delaware River), as set forth in the attached Map “Exhibit A”, to PAID by lease or by deed for further conveyance for nominal consideration. Conveyance of the property to PAID shall be conditioned upon a commitment by PAID to require an Economic Opportunity Plan in accordance with Section 17-1602 of The Philadelphia Code.

SECTION 3. The Commissioner of Public Property, on behalf of the City of Philadelphia, is authorized to acquire by deed up to 17.5 acres of land (including approximately 8 acres located between the Delaware River Bulkhead and Pierhead Lines) located at 3101 East Orthodox Street from PAID for nominal consideration.

SECTION 4. The Commissioner of Public Property, on behalf of the City of Philadelphia, is authorized to acquire by lease or by deed up to 7 acres of land in the area bounded by the Delaware River, Disston Street (extended to the Delaware River), Milnor Street and Princeton Avenue (extended to the Delaware River) from the Pennsylvania Fish and Boat Commission (“Fish & Boat”), for nominal consideration.

SECTION 5. This Ordinance authorizes the City Solicitor to include in each lease or deed in connection with the exchange of land authorized by this Ordinance those provisions that the City Solicitor deems necessary or appropriate to protect the interests of the City, and to prepare all additional agreements that the City Solicitor deems necessary or appropriate to protect the interests of the City.
