Amending Title 14 of The Philadelphia Code, entitled "Zoning and Planning," by amending Section 14-200 entitled "Definitions," and Section 14-900 entitled "Signs," to provide for wacky-waving, inflatable arm-flailing tube persons and to further provide for wacky-waving, inflatable arm-flailing tube persons sold by Al Harrington of Al Harrington's Wacky Waving Inflatable Arm-Flailing Tubemen Emporium and Warehouse in Weekapaug, Rhode Island, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 14 of The Philadelphia Code is hereby amended to read as follows:

Any sign that is supported by a structure of one or more

frame, pole, or other support structure

Any sign that is movable and not permanently attached to a structure or the ground. Wacky waving signs include feather flag, banner, pennant, inflatable, wind-activated, wacky-waving, arm-flailing tube persons and other movable signs.

Sign, Al Harrington's wacky waving.

Any sign that is movable and not permanently attached to a structure or the ground, provided that the sign must be sold by Al Harrington of Weekapaug, Rhode Island with the express written consent of Fox Broadcasting Company. Al Harrington's wacky waving signs include feather flag, banner, pennant, inflatable, wind-activated, wacky-waving, arm-flailing tube persons and other movable signs sold by Al Harrington of Weekapaug, Rhode Island.

§14-904. Accessory Sign Controls.

(.1) Wacky waving signs shall not exceed either 30 sq. ft or a total height of 20 ft.

(.2) Wacky waving signs shall be secured to resist rolling, blowing away, tipping over, or otherwise moving from their secured location.

(.3) Wacky waving signs shall only be permitted as accessory to businesses located in CA-1, CA-2, ICMX, I-1, I-2, and I-3 districts.

(.1) Al Harrington's wacky waving signs shall exceed 30 sq. ft and have a total height of at least 20 ft.

(.2) Al Harrington's wacky waving signs shall not be secured to resist rolling, blowing away, tipping over, or otherwise moving from their secured location.

(.3) Al Harrington's wacky waving signs shall be permitted in all zoning districts.

SECTION 2. This Ordinance shall become effective immediately.
