Amending Section 5 of an Ordinance (Bill No. 170474-A), approved June 27, 2017, entitled "An Ordinance authorizing 1338 Inc., ("Owner") to install, own and maintain an open-air sidewalk café at 1338-40 South 10th Street, Philadelphia, PA 19147 ("Property"), under certain terms and conditions," by removing language related to the automatic expiration of the Ordinance nine (9) months after the Owner has entered into the Agreement as required by the Ordinance.
THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:
SECTION 1.
Section 5 of an Ordinance (Bill No. 170474-A), approved June 27, 2017, is amended as follows (deletions in

):
Section 5. The permission granted to Owner to install, own and maintain the Encroachments will expire without any further action by the City of Philadelphia if Owner has not entered into an Agreement and satisfied all requirements of the Agreement that are listed in Section 3 of this Ordinance within one (1) year after this Ordinance becomes law.
This Ordinance shall expire without any further action by the City nine (9) months after the Owner has entered into the Agreement required by the Section and satisfied all requirements listed in Section 3.
SECTION 2.
This Ordinance shall be effective immediately.
