Amending Title 14 of The Philadelphia Code, entitled "Zoning and Planning," to create a new Eighth District Overlay and to prohibit certain uses therein; all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 14 of The Philadelphia Code is hereby amended to read as follows:

TITLE 14. ZONING AND PLANNING.

CHAPTER 14-500. OVERLAY ZONING DISTRICTS.

§ 14-523. /EDO, Eighth District Overlay District.

(1) Applicability.

The requirements of this /EDO, Eighth District Overlay District, apply to all residentially or commercially zoned properties in the Eighth Councilmanic District.

(2) Prohibited uses.

The following uses are prohibited:

(a) Day Care, including in-home day care, but not including adult day care.

(b) The following subcategories in the Vehicle and Vehicular Equipment Sales and Services Use Category:

(.1) Commercial Vehicle Repair and Maintenance.

(.2) Personal Vehicle Repair and Maintenance.

(.3) Vehicle Paint Finishing Shop.

(c) Any business that purchases or sells tires, whether new or used, as part of a principal use or an accessory use.

SECTION 2. This Ordinance shall be effective immediately.
