September 13, 2018 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning without my signature Bill No. 180430, which was passed by Council at its session on June 21, 2018. This bill creates definitions in the Philadelphia Code for a "Criminal and Defiant Trespasser" and delineates both police procedures on how to deal with these types of trespassers as well as court procedures for how the Courts should address these cases when they arise. Ultimately, the legislation may create ambiguities as it relates to victims of rental fraud and may not result in expedited court proceedings as desired by the legislation's sponsor. I am supportive of the intent behind the legislation to protect Philadelphia residents and homeowners which is why I have directed the Police Department to develop and implement new polices to address this type of crime. I am hereby returning without my signature Bill No. 180430, which was passed by Council at its session on June 21, 2018.
