THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 10 of The Philadelphia Code is hereby amended as follows:

TITLE 10. REGULATION OF INDIVIDUAL CONDUCT AND ACTIVITY.

CHAPTER 10-800 SAFETY

* * *

§ 10-841. Rooftop Conduct.

(1) Prohibited Conduct. No Person shall engage in the following on a roof, roof overhang or roof extension of a residential building, not designed and legally permitted for use as outdoor recreational space:

(a) Fighting

(b) Drinking alcoholic beverages

(c) Running across the roofs of adjacent properties

(d) Peering into skylights

(e) Tanning

(2) Penalty. The penalty for violation of this Section shall be a fine of not more than $300.00 and imprisonment for not more than 90 days.

(3) Enforcement. Persons who are found in violation of this Section shall be issued a Notice of Violation by the police or other authorized law enforcement officer.

(4) The provisions of this Section shall only apply to the areas within the /NCP, North Central Philadelphia Overlay District as described in § 14-506 of this code.

SECTION 2. This Ordinance shall be effective immediately.
