Amending Chapter 11-100 of The Philadelphia Code, entitled "General Provisions," to authorize the Streets Department to permit closure of the public right-of-way, including on street parking spaces, for public health, welfare and safety purposes during the COVID-19 public health emergency until December 31, 2020, including expansion of business uses that cannot operate in indoor environment or have limited indoor capacity and/or service due to the Covid-19 emergency, all under certain terms and conditions.

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 11-100 of The Philadelphia Code is hereby amended to read as follows:

§11-107. Public Health Emergency Closures of the Right-of-Way

(a)

The Streets Department is hereby authorized to establish by regulation procedures for application, implementation, and enforcement of permits for temporary Right-of-Way closure to protect public health, welfare and safety during a declared public health emergency, including for expansion of business uses that cannot operate in indoor environments or have limited indoor capacity and/or service due to the COVID-19 emergency, including closure of all of the street or limited portions, such as on-street parking spaces.

SECTION 2. This Ordinance shall be effective immediately and shall remain in effect until December 31, 2020, unless further extended by ordinance.
