THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Permission is hereby granted to Vincent Cappello (Permittee), owner and operator of Vinny’s Fruit and Produce, to permit overnight truck parking of his commercial vehicle located in the right-of-way on the north side of Dickinson Street between 9th and 10th Street, thus excepting the commercial vehicle of Vincent Cappello from Section 9-203(7)(k) and Section 12-901(3) of The Philadelphia Code, which prohibit the overnight truck parking of conveyances and commercial vehicles.

SECTION 2. Before exercising any rights or privileges under this Ordinance, Permittee must first obtain all required permits, licenses and approvals from all appropriate departments, boards, agencies or commissions, including, but not limited to, appropriate food establishment licensure pursuant to Section 6-301(4)(c) of the Philadelphia Code, appropriate street vendor licensure pursuant to Section 9-203(2) of The Philadelphia Code, the appropriate street vendor license plate, pursuant to Section 9-203(4) of The Philadelphia Code, and the appropriate weights and measures registrations required by Section 9-1400 of The Philadelphia Code. No such department, board, agency or commission shall be required to issue any such permit, license or approval solely because this Ordinance has been enacted, it being the express intent of this Ordinance not to supersede any other provision of law governing the issuance of such permits, licenses or approvals. Permittee must adhere to all other applicable Code provisions, including, but not limited to, Section 9-203(7)(f) regarding street vendor littering, Chapter 10-400 of The Philadelphia Code regarding noise and excessive vibrations requirements, Section 14-707 of The Philadelphia Code regarding outdoor lighting requirements, and Chapter 14-900 of The Philadelphia Code regarding sign requirements. Permittee shall not act as a Street Vendor and sell any Goods, Wares, or Merchandise except during permitted hours of operation. Permitted hours of operation shall be 9:00 a.m. to 8:00 p.m. Permittee shall not park his commercial vehicle: (1) in front of a public or private driveway, (2) within 15 feet of a fire hydrant, (3) within 20 feet of a crosswalk at an intersection, (4) within 30 feet upon the approach to any flashing signal, stop sign, yield sign or traffic-control signal located at the site of a roadway, or (5) where the vehicle would prevent the free movement of a streetcar.

SECTION 3. The permission granted to Permittee described in Section 1 shall expire without any further action by the City of Philadelphia if Permittee has not satisfied all requirements that are listed in Section 2 of this Ordinance within one (1) year after this Ordinance becomes law. The permission granted to Permittee described in Section 1 is not transferrable.

SECTION 4. This Ordinance shall take effect immediately.
