THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Chapter 10-100 of The Philadelphia Code is amended to read as follows:

CHAPTER 10-100. ANIMALS

§ 10-101. Definitions.

In this Chapter the following definitions apply:

Farm Animal. Any [chicken]

, goose, duck, turkey, goat, sheep, pig, cow, or other farm animal, provided such other farm animal presents a public nuisance due to smell and/or noise. Does not include a cat, dog,

hen,

or horse.

§ 10-103.2 Maximum Number of Hens Allowed.

(1)

Except in connection with the operation of a commercial farm or retailer, or unless the Animal Control Agency has granted a waiver pursuant to such regulations as it may establish, no more than the following numbers of hens may be kept on a parcel of land on which a residential dwelling unit is located:

(b)

Six (6) hens.

(.1) The hens must be kept in a fully enclosed coop, measuring at least one square foot per hen, and

(.2) There must be an open area (chicken run) of at least 2 square feet per hen.
