June 21, 2023 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning as disapproved Bill Number 230319, which was passed by Council at its session on June 8, 2023. Bill Number 230319 amends the Philadelphia Zoning Code by changing the zoning by revising Section 14-524, entitled '/FDO, Fourth District Overlay District," to extend the boundaries of certain areas. The bill requires a special exception for consumer goods, food, beverages and groceries, sundries, pharmaceuticals, and convenience sales in various Fourth District commercial corridors. While my Administration is supportive of the bill's intent to reduce nuisance business activity, this legislation - similar to Bill Number 220446, which I also vetoed - is not the appropriate tool to combat the genuine concerns sought to be addressed.
