Full Bill

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The Commissioner of Parks and Recreation, on behalf of the City of Philadelphia, is hereby authorized to enter into a multiyear agreement with Galaxy Restaurants Catering Group, LP d/b/a Constellation Culinary Group, for the management and operation of event planning and catering at the Fairmount Park Horticulture Center, which terms must be substantially consistent with those set forth in the term sheet attached to this Ordinance as Exhibit “A.”

SECTION 2. The City Solicitor is hereby authorized to review and approve the multiyear agreement authorized by this Ordinance, which multiyear agreement shall contain such terms and conditions as the City Solicitor shall deem necessary and proper to protect the interests of the City of Philadelphia and to carry out the purpose of this Ordinance.

EXHIBIT A

Terms of Proposed Multiyear Agreement

For Management and Operation of Event Planning and Catering at Fairmount Park Horticulture Center

1. Concessionaire: Galaxy Restaurants Catering Group, LP d/b/a Constellation Culinary Group.

2. Licensed Area: Fairmount Park Horticulture Center or portions thereof.

3. Purpose: Event Planning, Catering, and Catered Events.

4. Commencement Date: February 19, 2019.

5. Term: The Initial Term of the Agreement shall be for four (4) years; the City may exercise the option to renew the Term with a four-year First Renewal Term and a two-year Second Renewal Term.

6. Concession Fee: Concessionaire to pay annual Concession Fee pursuant to the Agreement.

7. Capital Improvement Funds: Concessionaire to provide payment to City pursuant to the Four-Year Term Capital Improvement Funds Schedule within the Agreement.

8. Equal Economic Opportunity: In accordance with an executed Antidiscrimination Policy attached to the Agreement.
