Authorizing the revision of lines and grades on a portion of City Plan Nos. 383, 384, 385, and 386 by relocating portions of the houselines and curblines of Southampton Road from The Roosevelt Boulevard to points northwestwardly therefrom, relocating portions of the easterly houseline and the curblines of Southampton-Byberry Road from The Roosevelt Boulevard to points southeastwardly and southwardly therefrom, and relocating portions of the curblines of The Roosevelt Boulevard from Southampton and Southampton-Byberry Roads to the Philadelphia-Bucks County Line, all under certain terms and conditions.

Full Bill

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Pursuant to Section 11-405 of The Philadelphia Code, the Board of Surveyors of the Department of Streets is hereby authorized to revise the lines and grades on a portion of City Plan Nos. 383, 384, 385, and 386 by:

a) Relocating the northeasterly houseline of Southampton Road, from The Roosevelt Boulevard to a point approximately six-hundred twelve feet northwestwardly therefrom, twenty-eight feet and varying distances northeastwardly, thereby widening said Southampton Road.

b) Relocating the northeasterly curbline of Southampton Road, from The Roosevelt Boulevard to a point approximately five-hundred eighty-two feet northwestwardly therefrom, twenty-two feet and varying distances northeastwardly, thereby widening the cartway of said Southampton Road.

c) Relocating portions of the northwesterly curbline of The Roosevelt Boulevard, between Southampton Road and the Philadelphia-Bucks County Line, varying distances northwestwardly.

d) Relocating the westerly curbline of Southampton-Byberry Road, from The Roosevelt Boulevard to a point approximately seven-hundred ninety-two feet southeastwardly and southwardly therefrom, one foot and a variable distance westwardly, thereby widening the cartway of said Southampton-Byberry Road.

e) Relocating the easterly houseline of Southampton-Byberry Road, from The Roosevelt Boulevard to a point approximately six-hundred thirty-nine feet southeastwardly and southwardly therefrom, twenty-five feet and a variable distance northwardly, thereby widening said Southampton-Byberry Road.

f) Relocating the easterly curbline of Southampton-Byberry Road, from The Roosevelt Boulevard to a point approximately six-hundred forty-five feet southeastwardly and southwardly therefrom, twenty-two feet and a variable distance northeastwardly, thereby widening the cartway of said Southampton-Byberry Road.

g) Relocating the southwesterly houseline and curbline of Southampton Road, from The Roosevelt Boulevard to a point approximately two-hundred twenty-six feet northwestwardly therefrom, twelve feet southwestwardly in order to conform more closely with existing conditions.

h) Relocating the southeasterly curbline of The Roosevelt Boulevard, from a point approximately seven-hundred ninety-four feet northeast of Southampton-Byberry Road to the Philadelphia-Bucks County Line, a variable distance northwestwardly in order to conform more closely with existing conditions.

SECTION 2. The City Plan changes authorized in Sections 1(a), 1(b), 1(c), and 1(d) of this Ordinance are conditional upon compliance with the following requirements within two (2) years from the date this Ordinance becomes law:

a) The filing of an agreement, satisfactory to the City Solicitor, by the party in interest to release, indemnify, and defend the City from all damages or claims for damages that may arise by reason of the City Plan changes authorized herein.

b) The dedication to the City by the owner or owners of property affected thereby, without cost and free and clear of all encumbrances, of the bed of the widened portion of Southampton Road as proposed to be placed on the City Plan by authority of Section 1(a) herein.

c) The payment by the party in interest of the cost of advertising the public hearing by the Board of Surveyors on the City Plan changes authorized by this Ordinance.

SECTION 3. The City Plan changes authorized in Sections 1(e) and 1(f) of this Ordinance are conditional upon the grant to the City by the Commonwealth of Pennsylvania of a highway right-of-way easement for the bed of the widened portion of Southampton-Byberry Road as proposed to be placed on City Plan by authority of Section 1(e) herein.

SECTION 4.

This Ordinance shall not become effective unless the sum of two hundred dollars ($200.00), toward costs thereof, is paid into the City Treasury within one hundred and twenty (120) days after this Ordinance becomes law.
