Amending Section 10-810 of the Philadelphia Code entitled "Weapons and Dangerous Devices," by revising and clarifying unlawful weapons and dangerous devices and unlawful conduct, and making technical changes; all under certain terms and conditions

THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 10 of The Philadelphia Code is hereby amended to read as follows:

TITLE 10. REGULATION OF INDIVIDUAL CONDUCT AND ACTIVITY

§ 10-810. Weapons and Dangerous Devices.

(3) Spring Guns, [Air Guns and Bows and Arrows]

Air Guns, Bows and Arrows, and other similar devices.

No person shall sell, offer for sale at retail, or use, possess with intent to use, cast, fire, shoot or discharge any air rifle or pistol, spring gun or pistol, compressed air rifle or pistol, or other similar device not a firearm which impels with force a shot, dart or pellet whether solid, liquid or particulate matter.

10-810(3)(a), shall have committed a Class III offense and shall be subject to the fines set forth in subsection 1-109(3), and upon referral from the Police Department, the Department of Licenses and Inspections, after providing notice and an opportunity to be heard, may suspend the commercial activity license of such person for no less than six months and no more than one year.

SECTION 2. This Ordinance shall take effect immediately.
