Full text

WHEREAS, Pursuant to Resolution No. 240585, the Council President, or a Councilmember designated by the Council President, shall have full authority to seek and retain legal counsel to file an appeal of the decision of the ZBA and to engage in any related litigation as may be necessary on behalf of and in the name of Council; and

WHEREAS, Resolution No. 240585 provides a procedure to authorize Council’s appeal of a decision when circumstances do not permit the passage of a resolution prior to the appeal deadline, and such procedure was invoked by Council President in August 2025 to meet the appeal deadline with respect to 5052-56 City Avenue; and

WHEREAS, This Council intends by this Resolution to authorize Councilmember Jones to be a party to such an appeal on its behalf and to ratify Councilmember Jones’s authority to file the appeal on behalf of and as representative of the Council; now, therefore, be it

RESOLVED, BY THE COUNCIL OF THE CITY OF PHILADELPHIA, That Councilmember Curtis Jones, Jr., has full authority to intervene in and thereafter as a party therein to prosecute and defend, on behalf of and as representative of this Council, the appeal of the decision of the ZBA with respect to 5052-56 City Avenue.

FURTHER RESOLVED, That this Council ratifies all steps taken to date by Councilmember Jones on behalf of and as representative of Council in said appeal.

FURTHER RESOLVED, That this Council authorizes Councilmember Jones to take all further steps on behalf of and as representative of Council with respect to such appeal as Councilmember Jones determines is appropriate for the successful prosecution and defense of such appeal, including, if necessary, any further appeals.
