THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. Title 10 of The Philadelphia Code is hereby amended to read as follows:

TITLE 10. REGULATION OF INDIVIDUAL CONDUCT

CHAPTER 10-700. REFUSE AND LITTERING

§ 10-722. Use of Dumpsters.

(4) Duties of Licensees.

(c)

Dumpster Maintenance.

(.2)

Licensees shall keep dumpster lids tightly secured

except when in use, or when the dumpster must be open to accommodate a trash chute, and shall keep the area around the dumpster clean and free of any refuse, non-grindable garbage, spillage or overflow.

(.a) In the case of metal dumpsters with a capacity of two or four cubic yards that are automated for pick-up by specialized garbage trucks, the dumpsters shall be secured by means of a lock. The Department of Streets is authorized to issue regulations with respect to this Subsection, including but not limited to regulations providing for a pilot program or phased roll-out, as appropriate.

SECTION 2. This Ordinance will take effect immediately.
