A proposed bill aims to regulate tobacco retailers and prevent the sale of tobacco products to minors in Philadelphia. However, the Mayor did not sign the bill due to concerns that it may be preempted by state law. This decision affects tobacco retailers and minors in the city.

March 04, 2026 TO THE PRESIDENT AND MEMBERS OF THE COUNCIL OF THE CITY OF PHILADELPHIA: I am hereby returning unsigned Bill Number 251097, introduced by Councilmember Anthony Phillips, and passed by City Council on February 19, 2026. This bill would amend the Philadelphia Code to impose new regulations on tobacco retailers and the sale of tobacco products to minors. While this legislation is well intentioned, the Law Department has advised that the bill is preempted by state law. For this reason, I am returning Bill Number 251097 unsigned. Respectfully, Cherelle L. Parker Mayor
