THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS:

SECTION 1. The Commissioner of Parks and Recreation, on behalf of the City of Philadelphia, is hereby authorized to enter into a multi-year lease agreement with the Fairmount Park Conservancy, under which the City will lease to the Conservancy portions of the City-owned premises known as Franklin Delano Roosevelt Park, located at 1500 Pattison Avenue and South Broad Street, for the Conservancy’s use, operation, management, maintenance, and repair, pursuant to certain terms and conditions set forth in the document attached hereto as Exhibit A.

SECTION 2. The Commissioner of Parks and Recreation is hereby authorized to take all actions deemed by the Commissioner to be necessary and appropriate to carry out the provisions and intent of this Ordinance, including executing all instruments and ancillary documents necessary and appropriate for the City to carry out the purposes of this Ordinance.

SECTION 3. The City Solicitor is hereby authorized to review and approve all instruments and documents necessary and helpful to effectuate this Ordinance, and to include in those instruments and documents such provisions as the City Solicitor deems necessary and proper to protect the interests of the City and to carry out the purpose of this Ordinance.

Terms of Proposed Lease

Landlord: The City of Philadelphia, acting through its Department of Parks and Recreation

Tenant: The Fairmount Park Conservancy

3.

Premises Address: Portions of Franklin Delano Roosevelt Park, located at 3500 S. Broad Street, Philadelphia, Pennsylvania 19145 (the “Welcome Center Complex”)

4.

Use of the Premises: Operation of the Welcome Center Complex

5.

Term of Lease: Up to 26 years.

6.

Renewals: None

7.

Rent: Nominal

8.

Maintenance and Utilities: Tenant will be responsible for the maintenance and utilities associated with the Welcome Center Complex.
